Terms of Service

1. Acceptance of Terms
By accessing or using Service Point ("the Platform"), you agree to be bound by these Terms of Service. If you are using the Platform on behalf of an organisation, you represent that you have authority to bind that organisation to these terms.
2. Description of Service
Service Point is a multi-tenant B2B2C SaaS platform providing field service management, humanitarian operations management, and emergency response coordination tools. The Platform includes desktop dashboards, mobile web applications, and native mobile apps.
3. Account Registration
You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials. You must notify us immediately of any unauthorised access.
4. Subscription & Billing
- Subscription plans are billed monthly or annually as selected at signup.
- Free trials do not require a credit card. After the trial period, you must subscribe to continue using the Platform.
- We accept M-Pesa, bank transfer, and credit/debit card payments.
- You may upgrade, downgrade, or cancel your subscription at any time. Changes are prorated.
- If payment fails, your account may be suspended after a 7-day grace period.
5. Acceptable Use
You agree not to:
- Use the Platform for any unlawful purpose
- Attempt to access data belonging to other organisations
- Reverse-engineer, decompile, or disassemble any part of the Platform
- Transmit viruses, malware, or other harmful code
- Exceed rate limits on API endpoints
- Share login credentials across multiple users
6. Data Ownership
You retain ownership of all data you upload to the Platform. We do not claim ownership of your organisation's data, including job records, patient records, beneficiary information, or documents. We are granted a limited licence to process your data solely to provide the service.
7. Patient Data (Emergency Services)
Organisations using emergency response features acknowledge that patient data is processed in compliance with the Kenya Digital Health Act and HL7 FHIR R4 standards. Patient data transmitted to hospitals is governed by the receiving hospital's data policies.
8. Service Availability
We aim for 99.9% uptime but do not guarantee uninterrupted access. We may perform scheduled maintenance with prior notice. We are not liable for downtime caused by third-party providers, force majeure, or circumstances beyond our control.
9. Limitation of Liability
To the maximum extent permitted by law, Service Point shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to loss of profits, data, or business opportunities.
10. Termination
Either party may terminate the agreement at any time. Upon termination, your data will be retained for 30 days before permanent deletion. You may request a data export before termination takes effect.
11. Changes to Terms
We may update these terms from time to time. Material changes will be communicated via email or in-app notification at least 14 days before taking effect.
12. Governing Law
These terms are governed by the laws of the Republic of Kenya. Any disputes shall be resolved through arbitration in Nairobi, Kenya.
